The Walkaround
Inform co-workers that the inspection is in progress and that they have a right to talk privately and confidentially to the inspector and to make their own verbal or written complaint to OSHA at anytime. The inspector may also conduct private interviews outside the workplace.
Since the interview is completely voluntary (unless OSHA subpoenaed the employee) the employee can end the interview at any time and can leave without any explanation. Has a right to refuse to sign a statement, be tape recorded or photographed.

OSHA officials can order work to stop if they find a severe risk on-site, but contrary to popular belief, they don't have the authority to shut down a business entirely. Only a court order can do that.
The students have 3 attempts to pass the final OSHA 30 exam. In case they fail all three attempts, they have to restart the entire training. If they pass the final exam, students receive a temporary card to certify that they have successfully graduated from the course.
Can you ignore OSHA?
From a legal perspective, the most important thing to remember is that OSHA regulations are law, and there can be serious repercussions if you are found to be noncompliant.
Once the Investigation is Over

How long is OSHA final exam?
Cal/OSHA Testing
The final exam contains 20 questions. You will have 180 minutes to complete the exam and earn a passing score of 70% or higher. Like the quizzes, you can retake the exam until you pass.

Phone/Fax Investigation
The employer must respond within five days, identifying in writing any problems found and noting corrective actions taken or planned.
Section 44 of the Act states that a worker has the right not to be subjected to any detriment where they leave work, or refuse to return to work, in circumstances where the worker reasonably believes there to be 'serious and imminent' danger, which they could not reasonably avoid.
Worker responsibility
A reasonable person must agree that a real danger exists. If the employer fails to take corrective action, make sure your intent to stop work due to unsafe acts is clear. You can stop work in good faith but you cannot walk off the job site unless dismissed by your employer.
Even though safety staff certified that the production area was fully compliant, employees have the right to file a complaint with OSHA when they believe working conditions are unsafe or unhealthful.
Protection from Retaliation
It is illegal for an employer to fire, demote, transfer or otherwise retaliate against a worker who complains to OSHA and uses their legal rights. If you believe you have been retaliated against in any way, file a whistleblower complaint within 30 days of the alleged retaliation.
As a worker in Quebec, you have the legal right to refuse unsafe work, according to Section 12 of the Act Respecting Occupational Health and Safety, when there are reasonable grounds to believe that performing the work would endanger you or another person's health, safety, or physical well-being.

How many times can you fail OSHA 30?
You will be given three attempts to pass an exam and must score at least 70% to pass. If you receive a failing grade three times on any one exam, it is considered a failure of the course.
Rest Breaks:
Employees who work 12 hours per day are also entitled to at least three 10-minute rest breaks. If the employee was not provided any of these rest breaks, the employee is entitled to an additional one hour pay at the regular rate.
Under the other whistleblower laws, if the evidence supports an employee's complaint of retaliation, OSHA will issue an order requiring the employer, as appropriate, to put the employee back to work, pay lost wages, and provide other possible relief.
Types of Violations
SERIOUS: A serious violation exists when the workplace hazard could cause an accident or illness that would most likely result in death or serious physical harm, unless the employer did not know or could not have known of the violation.
Request an informal conference with the OSHA area director, allowing you to discuss any portion of your citation. OSHA encourages employers to request a conference before deciding to contest a citation. Contest part or all of the notice, including the citation, penalty and/or abatement date.
If, following an investigation, an employer decides the whistleblowing was deliberately false or made in bad faith (e.g. out of spite or for personal gain) they could decide to take disciplinary action against the employee.
A prevailing whistleblower can obtain a wide range of remedies, including: (1) reinstatement, (2) back pay, (3) compensatory damages, (4) attorney fees and litigation costs; and (5) punitive damages up to $250,000. Preparing For the Inspection
For complaints that OSHA considers "serious," the inspection should occur within thirty days. If it does not, call and ask about the delay. You may want to tell co-workers and union activists that you filed a complaint, so they have time to prepare their comments to the inspector.
What is an acceptable OSHA incident rate?
A good TRIR rate is relative to the industry and type of work done, but once you've completed your calculation you can compare it to findings from the Bureau of Labor Statistics (BLS). Overall, the average OSHA Incident Rate is 2.9 cases per 100 full-time employees in private industry.
Most citations come with a fix-it deadline before the fine is collected, but serious citations may involve immediate fines as high as $7,000 per citation. For minor violations, you may only get a notice with no fine attached. Whatever the case, consider this your call-to-action to fix things.
If you wish to contest any portion of your citation, you must submit a Notice of Intent to Contest in writing to the OSHA area office within 15 working days after receipt of the Citation and Notification of Penalty.
This is the most common type of inspection. The Fatality/Accidents Inspection -- occurs after OSHA receives notice from the employer of a workplace fatality or an accident resulting in the hospitalization of three or more employees.
